ORDER : 1. Heard learned counsel for the parties. 2. Undoubtedly, there has been misquoting of the order made by this court and the respondent No. I has owned the responsibility for it and unconditional apology has been offered. 3. Learned counsel for respondent No. 1 agrees to withdraw the allegation made in the counter affidavit that the petitioner was the informant on telephone and on the basis of the information so disclosed the publication was made. It has therefore been taken that there is no material to suggest that the petitioner has given the information. 4. While accepting the apology tendered on behalf of respondent No. 1, we direct that not later than seven days from today in a daily issue of the paper the fact that wrong reporting had been made and the correct order of the court shall be published in the language in which the newspaper is printed, on the front page with appropriate headlines. 5. A sum of Rs. 100/- will be deposited within one week into the Registry of this Court towards costs. Learned Counsel for the respondent has undertaken before us and we hope the undertaking shall be carried out to the full effect that all care shall be taken in future to see that the proceedings of this court are not wrongly published. 6. Civil Miscellaneous Petition is disposed of accordingly.
