JUDGMENT : Having regard to the view taken by us in Civil Appeal No. 797 of 1976, the appeal must be allowed. The order passed by the, High Court is set aside. The Writ Petition will stand dismissed with liberty to the parties to raise all contentions on facts and law barring the contention that Section 12(2) of the Act is not attracted. No order as to costs.
