JUDGMENT Ravi S. Dhavan, J. - This is a tenant petition. An application was moved on 6th May, 1987 accompanied by an affidavit, stating in effect that the tenant would vacate the accommodation on 12th June, 1987 and deliver vacant and peaceable possession to the landlord. Shafiq Ahmad. The petition was moved on behalf the tenant through Sri D.V. Jaiswal, Advocate. The application filing an undertaking with a prayer that the petition be dismissed, has been moved through Mr. Malik Sayeeduddin, Advocate, learned Counsel appearing on behalf of the landlord Mr. Haider Husain, Advocate, is present at the Bar. He accepts the undertaking of the tenant. In the circumstances both the parties are agreed that this petition may now be dismissed without an order on merits. 2. Thus, in view of the facts on record an undertaking filed by the tenant, this petition is dismissed. Costs will be on parties. 3. A certified copy of this order may be delivered to learned Counsel for the parties within three days.
