ORDER : 1. The learned counsel for the appellant places reliances on the.' reported decision of this Court in Krishi Utpadan Mandi Samiti v. Ganga Dal Mill & Co., (1985) 1 SCR 787 , to contend that the view of the High Court is totally unpurportable and in view of the decision of this Court these appeals have to succeed. We have looked into the judgment of this Court as also the order dated 2.4.1987 in Modi Mills Case following the reported judgment where the stand taken by the High Court has not been accepted. The judgment of the High Court is set aside. 2. These appeals are accordingly allowed. There will be no order as to costs.
