(3) THE dispute in this bunch of appeals has been adjudicated bythe Calcutta bench ofthe central Administrative tribunal and that dcision is challenged.the South Eastern Raiiway authorities hve started implementing a scheme of rationalisation of a category of its services covering Station Masters and Assistant Station Masters andthe manner in which it is being done has been challenged as arbitrary, illgal and prejudicial. (4) TWO out ofthe many contentions advanced need to be noticed viz., (l)the Chief Personnel Officer while implementingthe scheme has deviated fromthe terms thereof and has implemented it tothe prjudice ofthe appellants, (2the scheme is being implemented in such a manner thatthe prsent status andemoluments admissible tothe appellants are going to be affected to their prjudice.the leamed counsel forthe respondents does not accept thse to be correct and is prepared to hve thse aspects examined bythe raiiway administration. Theie shall, there- fore, be a direction tothe Raiiway Board to examine within a period of t Arising out of S.L.P. (Civil) No. 6057 of 1987 OMPARKASHv.STATEOFPUNJAB 295 two months from today as to whetherthe allgation ofthe appellants on th first score is correct and ifthe Chief Personnel Officer is found to hve implementedthe scheme in a way diffrent from what was intended bythe scheme,the Board shall rectifythe situation to bring it in accord withthe scheme. Coming tothe other aspect, it is conceded thatthe scheme does not affectthe prsentemoluments or status ofthe appel- lants. We, therefore, make it clear that in implementingthe schemethe appellants shall not be affected in respect of their status as well asthe scale of pay which they hve been receiving at prsent. In course of com- plymg withthe prsent direction ifthe Raiiway Board finds that some incumbents who should not hve been entitled to certain advantages but hve wrongly got them in course of implementation ofthe scheme they may not be disturbed as we hve not given them an opportunity of hear- ing. Yet, if ail or any ofthe appellants are entitled to such benefits,the same may not be withheld for lack of posts. It would be forthe raiiway administration to meetsuch a situation. Untilthe Board examinesthe matter as directed status quo as existing today shall continue. (5) NO order as to costs.
