JUDGMENT B.N. Misra, J. - Heard learned counsel for the petitioner and standing counsel appearing for State Bank. In the facts and circumstances of this case we dispose of this writ petition with the following directions :- (i) The petitioner shall pay a sum of Rs. 25,000 twenty five thousand] by 21,-8-1987 and the entire balance sum remaining due shall be paid in three equal quartely instalments, the first instalment commencing on 1-11-1987. The Bank concerned shall accept the payment as that when deposited by the petitioner as directed above and shall issue proper receipts to the petitioner, photo copy of which the petitioner shall produce before the Recovery Officer within a week from the date of deposits. (ii) Subject to the payment being made within the time specified above, the recovery proceedings shall remain stayed, and (iii) On payment being made as aforesaid in full satisfaction of the certificate dues, the concerned authorities shall drop the recovery proceedings in according with law. 2. In case of failure of payment as directed above, the recovery proceedings shall continue as against the petitioner in accordance with law. It shall be open to the petitioner to ask the Bank concerned for regular submission of the "payment position" and upon such request being made, the Bank shall furnish the correct position to the petitioner. 3. A copy of this order may be give to the learned counsel for the petitioner on payment of usual charges during the course of the day, if possible.
