JUDGMENT 1. The petitioner was appointed by the Chief Engineer as Assistant Development Officer, Rural Engineering Service, Azamgarh. He has been suspended by the District Magistrate vide order dated 7.5.87 annexure 6. The petitioner has challenged the Jurisdiction of the District Magistrate. A similar writ petition No. 8653 of 1986 has been allowed by this Court. Learned State counsel has not been able to point out any explanation regarding plea of jurisdiction. As such the writ petition is allowed. The order dated 7.5.87 annexure 6 is quashed. It is made clear that it will be open for the competent authority to take disciplinary action against the petitioner if he so desires. As the suspension order has itself been quashed. The transfer order dated 20.6.87 contained in annexure 9, which is a consequential order, will automatically fall down. The competent authority may again from (sic) the transfer order. 2. The writ petition stands disposed of finally.
