JUDGMENT : The parties above-named have agreed to the following : 1. The petitioner shall deposit a sum of Rs. 2,00,000/- (Rupees two lakhs) only in the court of the Tenth Assistant Judge, City Civil Court, Hyderabad on or before 10th November 1987. 2. The decrees of the Andhra Pradesh High Court dated 4th February 2 1986 in second Appeal No. 957 of 1981 and Civil Revision Petition No. 4567 of 1981, as well as of the Chief Judge, City Civil Court, Hyderabad dated 27th June 1981 in Appeal Suit Nos. 9 of 1981 and 19 of 1981 are set aside and it is hereby declared that the registered Sale Deed executed by the late Smt. Mehtab Khatoon on 24th May 1960 in respect of property No. 16-4-95, Chanchal Guda Hyderabad in favour of the Plaintiff/Respondent is void and ineffective and no title vested in the plaintiff/respondent by reason of the said Sale Deed. 3. The respondent/plaintiff will be entitled to withdraw the amount of Rs. 2,00,000/- (Rupees two lakhs) doposited by the petitioner/defendant. 4. If the amount of Rs. 2,00,00/- (Rupees two lakhs) only is not deposited as aforesaid, a charge for the said amount will be created on the said property. 5. The parties are hereby agreed that they will withdraw all proceedings filed by each other before the City Civil Court or the Rent Controller, Hyderabad. 6. The parties will bear their own respective costs. Dated this the tenth day of August, 1987.
