ORDER : 1. We amend the guidelines formulated by this Court's order dated March 7, 1986, for regularising the1 distribution of manufacturer's 5% quota of Maruti. We order that the distribution of the manufacturer's quota hereafter shall be as specified in Schedule A. The CMPs are disposed of accordingly. SCHEDULE "A" The following conditions will be strictly observed in the allotment of vehicles to any organisation/institution, person or individual in any of the aforesaid category : (a) There will be no resale of the vehicle by the allottee for a period of three years. This condition will be inserted in the order of allotment issued in favour of the allottee's. Maruti Udyog Limited will further obtain before delivery of the vehicle a written undertaking from the allottees that he will not sell the vehicle for a period of three years from the date of delivery. (b) Second allotment to the same individual out of manufacturers quota could be made after lapse of four years from the date of collection of the vehicle in the previous allotment. (c) In each of the aforesaid categories, allotment so far as possible, will be made on first come first served basis in accordance with the date of receipt of the application for allotment out of MQ. In cases where more than one application is received on the same day from individuals in the same category, priority of allotment in such cases will determined by. draw of lots under proper supervision. (d) In case there are any surplus vehicles available for allotment under MQ in one or more categories then the same will be allocated to other categories. It is clarified that allotments made for military/para-military, fleet customers for use as taxi, against payments in foreign exchange, export order for supply outside India will not be included within 5% of the MQ. These guidelines will be in force for a period of three years. Subject to the conditions stipulated here In above the following shall be proposed guidelines on MQ Allotment. General in the Army or equivalent rank in the Navy or Air Force. 17% 25 (g) Winners of international/national awards in recognition of outstanding contribution in the fields of art, culture, humanity, sports and literature. 10 Vehicles 30 (h) Individuals in recognition of their outstanding services to the society or to nation. 10 Vehicles (i) Individual cases of undue hardship on compassionate grounds. 10 Vehicles 35 (j) Journalists, doctors, lawyers and professors. 5% (k) Joint Venture companies of MUL and manufacturers of component parts for utilisation in the manufacture of Maruti vehicles and MUL dealers. 6% 40 (l) Employees of the Company (m) Institutions/individuals not otherwise covered above, in the commercial interest of MUL as approved by MUL Board. Vehicles 45 IV. Retired persons of the categories eligible. 5% v. Error Category Individuals whose applications for regular allotment could not be registered on account of any genuine error.
