He also conducted search of the houses of the accused and prepared search memo (Ext. Ka-7 and 8) on 9-6-1978 and recorded the statements of Babu Lal (P. W. i) and Keshav Prasad (P. W. 4 ). The accused persons were not found on search. On receiving the post-mortem report, statements of Rajendra Prasad, Banshi Lal and others were recorded and the case was converted into one under Section 302 and Section 149, I. P. C. was also added. 3. Motive of the offence is said to be based on the fact that the accused had an irrigation channel upon which the injured had asked the accused to make a culvert which they had refused whereupon a quarrel ensued, on 21-9-1978 when the accused had attacked Keshav Prasad (P. W. 4) he is said to have lodged a report with the police but no action taken. 4. The prosecution examined Babu Lal injured (P. W. 1), Rarn Shankar (P. W. 2), Sukh Lal injured (P. W. 4) as eye-witnesses. The other witnesses examined were Dr. T. N. Mehrotra (P. W. 6) who performed the post-mortem examination on the body of the deceased, Din Dayal, Dr. M. P. Pratap (P. W. 7) who performed X-ray of injured Sukh Lal (P. W. 3), Dr. D. K. Shukla (P. W. 10) who examined the injured persons at Primary Health Centre, Dalmau, Investigat ing Officer Ram Lakhan Singh (P. W. 8) and some other formal witnesses. 5. The accused pleaded not guilty and denied having committed or participated in the alleged crime. The accused Rameshwai Prasad pleaded alibi and said that on the day of occurrence he had gone to Rao Bareli Court to do of his case under the Arms Act and attended the court alongwith three witnesses. The court hours were in the morning in that period. Accused Nand Kumar stated that on the date and time of the incident lie was on duty in the Central Bank of India at Lucknow. Accused Prabha Shankar, Ramesh Kumar and Jagdish Narain on the other hand pleaded having beaten with lathis in self-defence and set up a case that Prabha Shankar was returning from his thrashing floor and while he was on way to his home Keshav Prasad (P. W. 4), deceased Din Dayal. Babu Lal (P. W. I), Subh Lal (P. W. 3) and his son Bishambhar started assaulted him with lathis. On raising alarm his father Jagdish Narain and Ramesh Kumar were attracted to the spot and they too were assaulted by these persons which led them to make use of lathis in exercise of right of self-defence.
In support of their case the defence examined Naus Ahmad Khan (D. W. 1) who stated that on 6-19/8 on the basis of written report of Suresh Kumar a F. I. R. was entered and an entry in the G. D. (Ext. Kha-1) was made by Constable Moharrir Ram Baran Shukla, Dr. Vijai Kumar Goel (D. W. 2) was also examined to prove injuries on the person of Jagdish Narain, Prabha Shankar and Ramesh Kumar. The injury reports are Ext. Kha-2 to Kha 4. Some documentary evidence in the form of order-sheet dated 5-6-1978 in the case State v. Rameshwar, etc. , copies of sworn affidavits of witnesses Bhital Din, Devi Din and Shiv Kumar of the same day have also been brought on record. 6. We have heard learned Counsel for the parties and perused the record. 7. It will be pertinent to see here that accused Nand Kumar is the brother of accused Rameshwar Prasad and accused Prabha Shankar is the son of accused Jagdish Narain and accused Ramesh Kumar is the sons of accused Rameshwar Prasad. Accused Jagdish Narain is the uncle of accused Rameshwar irasad and thus all the accused are related to each other. The informant Babu Lal (P. W. 1) is the son of Din Dayal deceased, Keshav Prasad (P. W. 4) is the cousin of the deceased. In this way the two parties, on the side of the accused and the complainant, are related to each other. As stated herein above the motive for the crime is said to have been in regard to an irrigation channel which belong to the accused on which the complainants party wanted to build a culvert and this was refused by the accused and this led to the murder of Din Dayal in which, as stated hereinabove, Babu Lal (P. W. 1) was injured, Sutch Lal (P. W. 3) was injure and Keshav Prasad (P. W. 4) was also injured.
A caroful scrutiny of the prosecution witnesses indicates that in the written report (Ext, Ka-1) which wag handed over at the police station by the complainant Babu Lal (P. W. 1) it was stated that the complainants party yielded lathis in self-defence and it is further stated by Babu Lal (P. W. 1) in his cross-examination that: This demolishes the theory of the complainants side of yielding lathis in self-defence. A further scrutiny of the evidence of Ram Shankar (P. W. 2) m the cross-examination would indicate. For hindi--------- ---------------------------------- ----------------------------------- ------------------------------------------- -------------------------------------- Keshav Prasad (P. W. 4) states in his cross-examination that Jagdish Narain had filed a case against him an Din Dayal deceased in the Court of Canal Magisterial which was pending even at the time of his examination in the court on 3-1 1-1 980 and that his case against the accused was also going on there. He has further stated that he did not know as to how the accused persons sustained injuries since no one from his side attacked the accused persons. It is, thus, noteworthy that the theory of the complainants side of yielding lathis in self-defence is belied by this testimony though the O. D. entry of 8-6-1987 at 6. 20 p. m. on the basis of which a report of Suresh Kumar against Keshav Prasad, Din Dayal deceased, Babu Lal, Sukh Lal and Bishambhar Dayal (Ext. Ka-1) finds mention about the injuries on the person of Jagdish Narain, Prabha Shankat and Ramesh Kumar accused. Injury reports of these accused parsons have already been proved by Dr. Vijai Kumar Goel (D. V. 2) which are on record as Ext. Kha-2 to 4. The injury reports indicate that Dr. Vijai Kumir Goel was posted as Medical Officer at Primary Health Centre Daltnau and examined accused Prabha Shankar at 11. 15 a. m. on 5-6-1978 but he did not note down the time of examination of Jagdish Narain and Ramesh Kumar accus ed. The nature of the injuries was simple. At item No. 1 of the injury report of Jagdish Narain 3 cm x cm X skin deep lacerated wound on the head 12 cm above the left ear with fresh blood oozing there from was found besides other abrasions etc. totaling eight. At item Na.
The nature of the injuries was simple. At item No. 1 of the injury report of Jagdish Narain 3 cm x cm X skin deep lacerated wound on the head 12 cm above the left ear with fresh blood oozing there from was found besides other abrasions etc. totaling eight. At item Na. 1 of the injury report of accused Prabha Shankar a lacerated wound 3 cm x cm x skin deep 5 above left ear on the head from which fresh blood was oozing and similarly injury No. 1 of the injury report of accused Ramesh Kumar is a contused wound of 1 cm x 1 cm x skin deep in the centre of forehead besides other injuries and could be caused at about 6, 7 O Clock in the morning as per deposition of the sector, In view of major contradictions, in the evidence of the prosecution witnesses Babu Lal (P. W. 1), Ram Shankar (P. W. 2), Sukh Lal (P. W. 3) and Keshav Prasad (P. W, 4) with the F. I. R. story set up by the complainants side that they had also attacked and yeilded lathis in self-defence from which the subsequently retracted throws a great doubt on the prosecution story and we are satisfied that the prosecution has not been in a position to prove its case beyond reasonable doubt. The story of the defence was that Prabha Shankar accused was returning from his thrashing floor and on way to his home Keshav Prasad (P. W. 4), deceased Din Dayal, Babu Lal (P. W. 1) Sukh Lal (P. W. 3) and Bishambhar started assaulting him with their lathis and on his raising alarm Jagdish Narain and Ramesh Kumar came and in their effort to save Prabha Shankar they were also assaulted, cannot be rejected since it is supported by G. D,, entry (Ext. Kha-1) and the testimony of Dr. vijai Kumar Goel (D. W. 2) who examined the three accused persons for their injuries at about 11. 15 a. m. on the said day. In any case since the injuries were fresh on the person of these three accused persons the medical examination for these injuries must have taken place within 3 to 4 hours or there about and the defence version of attack by the complainants side cannot be ruled out.
15 a. m. on the said day. In any case since the injuries were fresh on the person of these three accused persons the medical examination for these injuries must have taken place within 3 to 4 hours or there about and the defence version of attack by the complainants side cannot be ruled out. This is also not improbable since it was the complainants party who bora grudge against the accused party for not permitting them to make a culvert over the irrigation channel of the accused on account of which the complainants party having attacked is not ruled out which is further strengthened by the injury reports and the G. D. entry which have been duly proved. 8. Coming to the defence of the fourth accused Nand Kumar, appellant No. 1, that he was, on the day of the occurrence, on duty in the Central Bank of India at Lucknow where he was employed. Even though no specific evidence to prove this alibi has been produced it is pertinent to point out that no specific role has been assigned to Nand Kumar. Accused Prabha Shankar also did not bring in the name of Nand Kumar along with Ramesh Kunar and Jagdish Narain whom he said had joined him to save him, conscious of the fact that Nand Kumar was serving in the Bank and was on duty there. As such it cannot be said that Nand Kumar was present on the spot and participated in the occurrence. More so the case against accused Prabha Shankar, Ramesh Kumar and Jagdish Narain not having been established beyond reasonable doubt and their plea of having exercised their right of self-defence which in view of the injuries on their person specially on the head they did not exceed their right to inflict injury at all on the deceased and other injured persons. The case against Nand Kumar accused-appellant in the circumstances has do not been proved beyond reasonable doubt. We have further no reason to disagree with the learned Sessions Judge in so far as he accepted the plea of alibi of accused Rameshwar Prasad whom he acquitted. 9.
The case against Nand Kumar accused-appellant in the circumstances has do not been proved beyond reasonable doubt. We have further no reason to disagree with the learned Sessions Judge in so far as he accepted the plea of alibi of accused Rameshwar Prasad whom he acquitted. 9. Other plea regarding that the fact the prosecution witnesses were inter ested and no independent witness was examined is also of significance and it can not be said that the witnesses deposed true facts more so since they were injured in view of the apparent contradictions in their testimony. It could not be said that no independent witness could be available specially when it is stated that the police station was three miles where other people must also be going from the village for taking n holy dip in river Ganga on the important bathing day as it admittedly was. The factum of the F. I. R. having been lodged at 3. 15 p. m. though the police station is admittedly at distance of three miles after a lapse of about seven hours is also not properly explained and the contention of the learned Counsel for the appellants that possibly it was after the complainants party had known that the accused person had been medically examined on the same day at 11. 1 a. m. that the F. I. R. was lodged at the police station by the complainants party. 10. On careful examination of the cumulative affect of the entire oral and documentary evidence we are of the opinion that the prosecution has failed to establish its case against the accessed persons beyond reasonable doubt. 11. The appeal accordingly stands allowed and the judgment and order dated 30-11-1981 passed by the IV Additional Sessions Judge, Rae Bare holding the accused guilty under Sections 302/324/325/323/34, I. P. C. as detained herein above in Sessions Trial No. 291 of 1980 is hereby set aside and the accused- appellants and acquitted of the charges. They are on bail. Their bail bonds are discharged. Appeal allowed. .
