JUDGMENT 1. - I have heard Mr. Ajeet Mal Singhvi, counsel for petitioner Jakir Hussain and Mr. S.K. Mathur, Public Prosecutor at length. 2. The previous anticipatory bail application was rejected on October 29, 1987. Mr. Singhvi laid particular emphasis on the nature of the injuries sustained by Manoj Kumar and Ramkumar. He also showed injury-report. Manoj Kumar had an incised wound on right shoulder. The injury was simple by a sharp edged weapon. Ramkumar has a lacerated wound on right parietal region. This injury was simple and by blunt weapon. 3. Having regard to all the facts and circumstances of the case and particularly the nature of the injuries, it is directed that petitioner Jakir Hussain son of Ajijudeen Bhutta resident of Mandalgarh, District Bhilwara, in the event of arrest by the Officer Incharge of the Police Station Mandalgarh on the accusation made against him in F.I.R. No. 116/87 of the said Police Station on the basis of which a case under section 307 IPC has been registered against him, be released on bail on his furnishing a personal bond in the sum of Rs. 4000/- (Rupees four thousand only) with two sureties in the sums of Rs 2000/- (Rupees two thousand only) each to the satisfaction of the said Police Station to appear before him in connection with interrogation of the said case registered at the said Police Station whenever called upon to do so and in this direction of this Court following conditions are also imposed on the petitioner:- (i) that the petitioner shall make himself available for interrogation by a police officer as and when required; (ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police Officer; (iii) that the petitioner shall not leave India without the previous permission of the Court; and (iv) that the petitioner shall surrender himself to the Police for a brief period of two days for interrogation and for discovery, if any to be made under section 27 of the Evidence Act. 4. This surrender will be made by him on November 20, 1987.Anticipatory bail granted. *******
