ORDER 1.3.1988. It appears that on earlier occasion bail application of the petitioner was heard and disposed of by Hon’ble Mr. Justice R.C.P. Sinha. From the order dated 1.3.88, it appears that this case was ordered to be listed for admission before a Bench presided over by the Hon’ble Mr. Justice R.C.P. Sinha. It further appears that on earlier occasion on 19.1.88 in Criminal mise. Case No. 10799 of 1987 the prayer for bail of the petitioner was rejected by his Lordships Hon’ble Mr. Justice R.C.P. Sinha observing that the prayer for bail of the petitioner is refused at this stage. Therefore, I am inclined to hear this case. Let this case be removed from my list. Sd/-- B. Prasad. 4/--17.3.88. Heard the leaned counsel for the petitioners Mr. R. Griyaghey. He has submitted that the matter was ordered to be placed for admission before His Lordship Hon’ble Mr. Justice R.C.P. Sinha since the earlier order dated 18.1.1988 was passed by him. It was, however, submitted that Hon’ble Mr. Justice R.C.P. Sinha is not available for two weeks and this fact has been verified by the learned advocate from the Deputy Registrar of this court. Under this circumstances, it was submitted that in view of the fact that the petitioner is aged about 75 years and his wife is seriously ill, this matter may be placed before this Bench where it was listed earlier Drawing a line of distinction with the case of Shahzad Hasan Khan Versus. Ishtiaq Hassan Khan it has been submitted on behalf of the petitioner that in the said case of the Honble Judge who had passed earlier order, was available on the relevant date. In the present case, however, it has been submitted that Honble Mr. Justice R.C.P. Sinha will not be available for two weeks. In view of this submission let the case be placed under the same heading before me on 21.3.1988.
