JUDGMENT S.K. Lakhtakia, Member. - This is a revision filed against the order of Additional Commissioner, Meerut Division, Meerut dated 2-12-1986 through which an appeal filed against the order of the S.D.O. Jansath, dated 26-8-1986 was dismissed. 2. The facts of this case in short are that opposite party no. 1 Bricks Association through its partner Sri Jagannath Singh Anand applied to the S.D.O. to declare the land in dispute as non-agricultural land under Section 143 of U,P. Z.A. & L.R. Act. The land was recorded as Bhumidhari of Sohan Lal, Ved Prakash and Jagdish from whom it was purchased by the revisionist through sale deeds dated 23-1-1986 and 23-2-1986. The trial court allowed the application of O.P. No. 1 and declared the land as non-agricultural land under Section 143. An appeal filed against that order was also dismissed, hence this revision. 3. Heard the learned counsel for both the parties. Perused the record. 4. In this court the opposite party no. 1 has filed an affidavit stating that the revision be allowed and the orders passed by both the courts below be set aside. 5. In my opinion a bhumidhar is permitted to use his land in any way as provided under Section 141 of U.P. Act No. 1 of 1951 and even if the land is not used for agricultural purposes or the like it is not necessary that it may be declared as non-agricultural land. The order of declaration under Section 143 can, therefore, be made only on the application of the bhumidhar himself and not on the application of any other person. In the instant case the revisionists are bhumidhars of the land and there was no application made on their behalf for the declaration under Section 143 of U.P. Act No. 1 of 1951, hence there was no question for allowing the petition of the opposite party to make a declaration under that Section. The orders passed by both the courts below are, therefore, misconceived and are, therefore, liable to be set aside. 6. The revision is, therefore, allowed and the orders passed by both the courts below are set aside. The entry of bhumidhari shall continue.
