Judgment By order dated 10-12-1987, the matter has been referred to a Division Bench. The relevant part of the order reads thus : - "Order XIII, rules 1 and 2 of the Code of Civil Procedure requires documents to be filed before the framing or the issues. Subsequent filing of documents can only be done after cause is shown. Sub-Clause (2) of rule 2 of Order XIII, however, lays down that documents used for the purposes or cross-examination will not be subjected to the disability of sub-clause (1) of rule 2 of this Order. Order XVIII rule 17A of the Code of Civil Procedure is also relating to the filing of documents. What has to be decided is how sub-clause (2) of rule 2 or Order XIII affects the aforesaid two clauses viz. sub-clause (1) of Rule 2 or Order XIII and rule 17A or Order XVIII of the Code of Civil Procedure?" 2. On a deeper examination we feel that the matter need not detain us further be cause the Initial impression was that the two provisions of law in Order XIII rules 1 and 2 and sub-clause (2) of rule 2 of Order XIII C.P.C. appear to be contradicting themselves. 3. Further, on a deeper examination it appears that three disjointed situations envisaged in the concerned provisions are meant for three different stages altogether. One is that the documents should be filed on which the parties rely before the issues are framed the second, documents can be taken into evidence after the issues are framed only when sufficient causes are shown for not filing the same in time and the third stage is when it document can be produced while a witness is being examined or cross-examined and his attention is drawn to that document and it relates to a matter arising out of such examination. 4. Learned counsel for the petitioner, however now wishes to withdraw this application because he feels that he will urge the question of the effect of non-admissibility of the document in the trial itself. 5 This application is permitted to be withdrawn as prayed for.
