M. P. CHANDRAKANTHARAJ, J. ( 1 ) IT is represented by Mr. Goulay that petitioner-Bangera died long ago. It is further submitted by him that with his death any cause of action he had has also died and therefore this petition does not survive for consideration. There is force in this submission. ( 2 ) HOWEVER, Mr. Raghavendrachar submits that the present impleading applicant was also a promoter of the society and therefore he may come on record as a successor in interest. ( 3 ) THE Court is not inclined to accept that view. A co-promoter is not a legal heir nor a legal representative nor a successor in law. ( 4 ) THEREFORE, the petition has abated on the death of the petitioner. It is dismissed as such. --- *** --- .
