JUDGMENT 1. - Accused petitioners are in jail for more than one year and I am informed that the author of the report has not turned up despite the issuance of warrant. Though the offence is one under Section 302 I.P.C., prosecution's allegation is that the gun was used from the reverse side and it has not been fired, hence the question of intention will also have to be decided by the trial court. Looking to all the facts and circumstances of the case, I accept this bail application. 2. It is, therefore, directed that accused Anwar and Sabuddin shall be released on bail provided each of them furnish a personal bond in the sum of Rs. 10,000/- (Rupees ten thousand) with two sureties in the sum of Rs. 5,000/- each to the satisfaction of the trial court with the stipulation to appear before that court as and when called upon to do so during the pendency of the trial in this case against them.Bail Granted. *******
