ORDER : Sabyasachi Mukharji, J. 1. So far as claim for payment of gratuity and provident fund of those employees, who have not yet been taken over by the National Textiles Corpn. or the Govt. of India pursuant to the Act in question, concerned, learned Attorney General will nominate officer of NTC to go into this question and such officer will communicate the same to the trustees and the same amount will continue to remain with the trustees rest will be handed over to the NTC. 2. So far as any claim of dividend is concerned, the NTG will hand over the same in accordance with law to the Central Govt. and inform about the same to the petitioner Company. 3. So far as banks accounts are concerned, any amount standing to the credit of the Company in the Bank of Maharashtra, Kanpur, opened after 1983, will be handed over to the petitioner. Particulars of Account would he given to the NTC within one week. In those circumstances the NTC and the Union of India will withdraw the letters written to the Bank. On the handing over of the amount of gratuity and provident fund in terns of the aforesaid order the suits filed in the Court of learned Munsif, Kanpur, mentioned in the petition, will stand as withdrawn. The money will be handed over notwithstanding any Order of the learned Munsif. 4. The C.M.P. is disposed of accordingly.
