JUDGMENT S.B. Sinha, J. In this application the petitioner the has prayed for the following reliefs : "To issue an appropriate writs, orders commanding the respondents to immediately release and deliver 140 bags of rice weighing 140 quintals, 54 K. gs. and 100 Grams to the petitioner. (ii) Costs incidental to this petition may be awarded in favour of the petitioner." 2. By an order dated 16.2.1984 after hearing the counsel for the petitioner and the respondents, this court directed the respondents to release the rice in question, which was seized from Truck No. P.J.X. 4575 on 5.2.1984 to the petitioner on his undertaking and to re-deposit the same, if an appropriate order is passed in this regard by a lawful authority. 3. Mr. Agrawal, the learned counsel for the petitioner states that till today no order has been passed by any authority directing the petitioner to re-deposit the said rice. 4. In view of the undertaking aforementioned this writ application is disposed of with the observations that if any authority empowered to pass an order in this regard direct the petitioner to re-deposit the aforementioned amount of rice in terms of the Bihar Rice and Paddy Procurement Order, 1983, the petitioner shall abide by the aforementioned undertaking. 5. With the aforementioned observations and directions this writ application is disposed of. However, there will be no order as to costs.
