Order After hearing learned Advocate Mr. Ram Kishore Prasad, who appeared for the writ petitioner in Cr. W.J.C. No. 157 of 1988 (R) and the learned Standing Counsel No. 1 and the Government Pleader No. 2, who have appeared for the respondents, we dispose of the above two writ petitions concerning the same subject by the following order:- The Director of Probation has been made a party to the C.W.J.C. No. 1154 of 1987 (R). He is directed to visit Hatia Probation Home at Hatia, Ranchi, within one month from the date of production of a copy of this order and submit a report to this Court on the specific items indicated below stating the steps, if any, taken so far in respect thereof for improvement of the said Home and indicating further steps that may be taken in future in respect thereof. 2. From the materials on record it appears that: (i) The existing building for the Home is in disrepair and is not water proof. It is stated that shifting of the Home to a new building is under contemplation. In the event the Home continues in the existing building till the next rainy season, the roof must be provided with tiles. (ii) Sufficient numbers of cots are not available for use of the inmates of the Home. It is to be ascertained whether any other essential items of furniture are required for the Home. Steps should be taken for providing the same. (iii) The condition of the bath rooms and toilets in the existing building needs improvement. Such essential sanitary facilities should be provided for and supply of adequate water and electricity ensured. (iv) A specific report on the present diet provided to the inmates of the Home should be made, with suggestions for improvement of the same, if necessary, as also the funds available for the same. (v) Whether other amenities like soap, oil and other essential toilet items are being supplied at the Home, should be ascertained. (vi) The existing medical services presently being provided for the inmates of the Home. If not, the Director of Probation will arrange for steps to be taken for such services. (vii) There are no arrangements for providing education or vocational training to the inmates of the Home due to want of sufficient funds.

The Director should draw up a scheme for imparting such training and suggest ways and means for such training. (viii) The staff employed at the said Home are not being paid their salaries regularly. Steps should be taken so that the existing staff be paid their salaries in time. (ix) Whether steps are being taken to locate and contact the relations and guardians of the inmate, of the Home so that the latter may be returned to and rehabilitated with their own families." 3. The Director of Probation will submit his report within one month from his inspection of the said Home with two copies. One copy of such report should be made available to the learned Advocate appearing for the State for being communicated to the State of Bihar. The State of Bihar will consider and act upon such report as may be necessary. 4. We make it clear that we have indicated above only the major and essential items for maintaining and improving the said Home. It will be open to the Director to suggest further or other steps so that the said Home can be run better. The Director of Probation, if so advised, may obtain information from 'the Care Home', Patna, which is an institution similar to that in Hatia and is being run by the Welfare Department of the State of Bihar. The State of Bihar will ensure that the facilities, which have been and are being provided at the Care Home at Patna, are also provided for the Home at Hatia. 5. The two writ petitions are being disposed of as aforesaid but it will be open to the parties to seek further and other directions from Court as may be necessary from time to time. 6. Let a copy of this order be furnished to the learned Standing Counsel as also learned Advocate for the petitioners.
