JUDGMENT V.P. Mathur, J. - Taken up after the revision of the list. 2. No one appears on behalf of the revisionist. 3. The revision is directed against the conviction of the revisionist, vide, order dated 17-4-1980 passed by the Chief Judicial Magistrate, Lalitpur in Criminal Case No. 227 of 1978 under sections 7 read with 16 of the Prevention of Food Adulteration Act. He has been sentenced to six months' rigorous imprisonment and a fine of Rs. 1000/- was also imposed. Mr. KM Chaturvedi, Additional Sessions Judge, Lalitpur, while disposing of Criminal Appeal No. 28 of 1980, dismissed the appeal filed against the order of conviction and sentence, on 11-8-1981. 4. I have perused the judgments of the Courts below. Findings of fact have been recorded by both the Courts below. It stands established from the evidence that on 29-4-1977 at about 10 A.M. in village Panari within the police station-Kotwali Lalitpur, Sri R. P. Lokshyakar, Food Inspector found the revisionist carrying 15 litres buffalo milk in two cans hanging on his cycle, for sale. A sample was taken according to the rules. It was sent to the Public Analyst. It was found deficient in fatty contents by 5 per cent and non-fatty solids by 11 per cent. A copy of the report was sent. A complaint was filed after obtaining sanction of the authority concerned. 5. All the points now raised in this revision were considered by the learned Courts below and in my opinion, the conviction and the order of I sentence are both justified. There is no force in this revision, which is hereby dismissed. 6. The order granting bail on 26-8-1981 is vacated. The record shall be sent back to the Court below for proceeding further in the matter. 7. The revisionist is directed to surrender and shall be taken into custody to serve out the sentence and the amount of fine shall be realised.
