N. C. Kochhar ( 1 ) M/s Regal Scale Industries (the contractor) entered into a contract with the Union of India for supply of one Weigh Bridge Model DLA - 403 capacity 20 MT. Formal agreement bearing A/t. No. SDP-2/107 5705/4-7-80/92/paod/188 dated 6th March 1981 was executed by the parties. This agreement was governed by an arbitration clause. The dispuies having arisen between the parties, they were referred to the sole arbitration of Dr. B. N. Mani. Additional Legal Adviser to the Government of India, Ministry of Law and Justice, New Delhi (the arbitrator ). The arbitrator entered upon the reference and made his award dated 6th May 1987 which he filed in the court. ( 2 ) NOTICES of the filing of the award issued to the parties. The contractor was served with notice on 19th November 1987 and the Union of India was served with this notice on 8th December 1987. Although the statutory period has long expired, no objections have been filed by either of the parties. ( 3 ) I have gone through the award. I do not find any invalidity or illegality therein and there is no ground for remitting the same. ( 4 ) CONSEQUENTLY, the award is made rule of the court with the direction that the decree be drawn in terms thereof. The Union of India shall make the payment of the amount due to the contractor under the award within a period of two months from today failing which the contractor will be entitled to charage interest on the side amount @ 9% p. a. from the date of the decree. ( 5 ) SUIT No. 2275-A/87 stands disposed of accordingly.
