JUDGMENT 1. A notice of this writ petition was directed to be served on the respondent No. 3. An affidavit of service has been filed annexing the notice issued to the respondent No. 3 showing that he has been served. There is no counter - affidavit on record. The name of no counsel appears for the respondent in the cause list. We have heard the learned counsel for the petitioner and the Standing Counsel. 2. The two rival Committee of Management claim to have been elected as management of the institution. The Deputy Director of Education, Agra Region, Agra, by his order dated 14.4.1988 has not recognised either of the Committee of Management. He has, however, recognised the erstwhile Committee of Management for a limited duration and has directed it to conduct the elections of the Committee of Management. 3. The Deputy Director of Education should not have directed the Committee of Management whose term has expired, to conduct the elections. 4. We therefore, quash the order/dated 15.4.1985 in so far as it directs the erstwhile Committee of Management to conduct the elections and direct the Deputy Director of Education or his nominees who may be a District Inspector of Schools, but not either of the contesting parties to conduct the elections within three months from today's date. With these directions, the writ petition is disposed of.
