(1) IF the petitioner-wife applies for any adjournment after the respondent-husband reaches Madras in order io appear in the Court this order of transfer will stand revoked and the matter will be sent back to the City Civil court, Bombay. (2) IF the petitioner-wife seeks and obtains adjournment on more than three occasions at the hearings at which the husband is present through his Advocate, and not in person, this order of transfer will stand revoked and the matter will go back to the City Civil court, Bombay. We request the City Civil court at Madras to which the Divorce petition will stand transferred in pursuance of the present order being passed by us to ensure that the matter is accorded priority and the case proceeds on the date of hearing fixed by the court having regard to the fact that the respondent has to go to Madras all the way from Bombay at considerable time-cost and money-cost and to remain away from his job at Bombay. The learned Judge of the City Civil Court, Madras will, therefore, be good enough to accord priority to this matter and to proceed with the matter on the date fixed for hearing, if necessary, by adjourning other matters and to take the matter from day-to-day to the extent possible. (3) THE Registry will send a copy of this order to the learned Registrar of the City Civil court at Madras so that the directions given by us are brought to the notice of the learned Judge presiding over the Couri to which the matter may be assigned by the learned Principal Judge. (4) THE prayer for transfer is granted in the aforesaid terms. The matter will stand transferred to the City Civil court at Madras. (5) PARTIES may personally or through Advocates appear before the learned Registrar of the City Civil court, Madras on 1/11/1988 so that they can be apprised of the date of hearing and the court to which the matter is to be assigned. (6) WE hope that the City Civil court, Madras will be able to dispose of this matter as early as possible.
