JUDGMENT 1. - In this case several accused persons, except accused petitioner have been granted indulgence of anticipatory bail and they have been so released. The petitioner's application in past had been rejected. He has, however, surrendered before this Court today. Keeping in view the circumstances of the case and the fact that all other accused have been given the benefit of anticipatory bail and the petitioner has surrendered before this Court, this application be treated to be one under Section 439 Cr. P. C. It is directed that accused-petitioner Nanda shall be released on bail provided he furnishes a personal bond in the sum of Rs. 10,000/- (Rupees ten thousand) with two sureties in the sum of Rs. 5,000/- each to the satisfaction of the Addl. Registrar Judge with the stipulation that he shall appear before the Investigating officer within two weeks and make himself available for investigation and as and when call upon to do so during the pendency of the trial in this case against him. If he does not do that, then it will be open for the prosecution to move for the cancellation the bail.Bail Granted. *******
