JUDGMENT 1. - Heard learned counsel for the petitioner and the learned Public Prosecutor. 2. The FIR was lodged by 5 persons, out of which 3 were injured persons. In the F.I.R. the names of petitioners No.4 and 5 do not appear. It is also given out that Mahavir petitioner No 3 is minor as is evident from the order of the trial court also. Regarding Prabhulal, it is stated that he had lathi in his hand and has caused injury by Lathi to Chaturbhuj Petitioner Chanda is said to have been armed with Gandasa, who is 55 years old. It is therefore, submitted that the petitioners deserve to be released on bail. 3. The contention of learned Public prosecutor is that two persons Ram Lal and Gopal have been released on bail under section 439 Cr. P.C. It is therefore, submitted that these persons can also make an application at the appropriate time under section 439 Cr.P.C. 4. In the facts and circumstances of the case, since the names of Bhuriya and Durga Lal do not appear in the F.I.R. and Mahaveer, who is a minor. I am inclined to grant indulgence to the above 3 persons under the provisions of section 438 Cr.P.C. It is, therefore, ordered that in the event of arrest of the petitioners Mahaveera, Bhhoria, and Durgalal in F.I.R. No. 183/87, they be released on bail provided each of them furnishes a personal bond in the sum of Rs. 5000/- with one surety each in the like amount to the satisfaction of S.H.O./Arresting Officer/Investing Officer, Police Station Sadar, Bundi, on the following conditions 1. that the petitioners shall make themselves available for interrogation by a police officer as and when required ; 2. that the petitioners shall not, directly or indirectly, make any inducement, thereat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer ; 3. that the petitioners shall not leave India without the previous permission of the court. The bail application of Prabhulal and Chanda is rejected.Application allowed. *******
