JUDGMENT 1. - This revision is against the trial Court's order dated 6th February, 1982, to the extent it refused to permit the petitioners to participate in the proceedings even from the stage they have appeared for this purpose. This had been done merely on the ground that on account of their failure to to appear on 11th Dec. 1981, an exparte order was made against them which has the effect of depriving them of their right to appear and participate in the proceedings even at the subsequent stage. 2. The only grievance made by the learned counsel for the petitioners is that the petitioners cannot be refused permission to participate in the proceedings from the stage they have appeared, in spite of the earlier order dated 11th Dec. 1981 when they were not present in Court, since the petitioners do not want to be relegated to the earlier position. It is settled that such a permission cannot be refused to the petitioners when their prayer is not to be relegated to any earlier stage at which they may have remained absent. The impugned order dated 6th Feb. 1982 is, therefore, set aside to this extent only. 3. Consequently, the revision is allowed only to the extent indicated above.
