JUDGMENT 1. The averments arc these. For constructing tube - well No. 11 in village Jiwapur, district Ghazipur, the land of the father of petitioner was acquired. According to the relevant Government orders, a person, whose land is acquired or his dependent, should be given preference in the matter of appointment at the particular tube - well if he is otherwise qualifies. The petitioner is duly qualified to be appointed as a tube - well operator. Instead of the petitioner, some one also has been appointed. On 6th May, 1988, the father of the petitioner has made a representation to the Executive Engineer, Irrigation Department, Ghazipur, respondent No. 1. that representation is still pending. There is an immienent danger of the appointed, who is arrayed as respondent No. 2 in this petition, taking over the charge as tube - well operator. Hence this petition. 2. The representation made by the petitioner shall be disposed of by the Executive Engineer, Irrigation Department, Ghazipur, respondent No. 1, very expeditiously. The Executive Engineer shall take note of the Government order, referred to above, while disposing of the representation. Meanwhile if Sri Amed Singh, respondent No. 2, or any body else is appointed as a tube - well operator at tube - well No. 11, the appointment shall be subject to the decision of the representation of the petitioner's father. 3. With these observations, the writ petition is disposed of finally. 4. A copy of this order may be given to the Learned counsel for die petitioner on payment of usual charges within three days.
