JUDGMENT 1. This application is under Section 439 Cr. P.C. The petitioners are married men of age 25 and 18 years respectively. The girl in this question is also a married woman of about 25 years. It has been contended that the first time she shouted, was after the act of alleged rape was over and when one Bhagirath Singh saw the petitioners with the woman. Other eye witnesses in the case, came to the site only at the time when the accused persons were running away. The first information report in the case was also lodged after a delay of 24 hours. The petitioners are neighbourers of the woman and knew her from before. Considering all these circumstances when the trial of the case is likely to take time and the petitioners have already been arrested and it is not a case of anticipatory bail they can be released on bail. 2. It is, therefore, directed that the accused petitioners be released on bail provided each of them furnishes bail bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with one surety in the like amount to the satisfaction of the trial Court with the stipulation to appear before trial court as and when called upon to do so during the pendency of the trial against then in this case.Bail granted. *******
