JUDGMENT 1. The petitioner, in this writ petition, has challenged the order of suspension passed by the District Assistant Registrar dated 19th of July, 1988. The petitioner has been working as Supervisor of U.P. Co - operative Union. 2. The grievance, which has been raised in this writ petition is that the Chairman of the District Committee has to place within 15 days the papers of suspension and other relevant documents before the appointing authority who happens to be the Deputy Registrar and in case of failure, the appointing authority will have a power to revoke the order of suspension. In this connection, it has also been stated by the petitioner that he had moved an application before the Deputy Registrar, which has been annexed as Annexure - 3 to the writ petition. It has been asserted that neither the suspension order nor any relevant papers have been placed before the Deputy Registrar, who is the appointing authority. A prayer has been made that a writ of mandamus be issued to the Deputy Registrar, to annual the suspension order passed against the petitioner. 3. At the admission stage, we have heard Sri Trilokinath, counsel appearing for the respondents Nos. 1 and 2 and the writ petition is being disposed of finally in accordance with the Rules of this Court. 4. It has not been disputed before us that according to Regulation 67 it is incumbent on the Chairman of the District Committee to place the order of suspension within 15 days of the making of the suspension order alongwith the relevant papers before the appointing authority who in this case happens to be the Deputy Registrar for its approval. In case, the suspension order the relevant papers are not placed within 15 days, the appointing authority has powers to annual the suspension order. The petitioner has made a representation to the Deputy Registrar in this connection. In case, the Deputy Registrar has not adverted himself to the provisions of Regulation 67, the same shall be done by him now within a period of one month from the date of filing of certified copy of our order and the copy of writ petition. Subject to the aforesaid observation, the present writ petition is finally disposed of. A certified copy of this order shall be given to the learned counsel for the parties payment of usual charges within three days.
