Order The Bihar Forest Produce (Regulation of Trade) Act, 1984 has come into force throughout the State of Bihar. According to the petitioners, in the Schedule to the Act, Ekesiya and Chakundi have not been mentioned. The petitioners are, therefore not liable to sell these two types of trees to the State Trading Division of the Forest Department. Learned G.P. II could not produce any notification to show that the aforesaid two types of trees have been included in the schedule to the Act. 2. In this view of the matter, we dispose of this writ application with a direction to the respondents to allow the petitioners to cut and remove the timber or any other produce of Ekesiya and Chakundi trees, if these two types of trees have not been included in the Schedule to the Act.
