JUDGMENT 1. - Heard and perused the case diary.The accused-petitioner is involved in police case No. 290/88 pending investigation at Police Station, Gangapur City for offence under Sections 406, 409 & 420 I.P.C. The petitioner was Head Master of the Govt. Secondary School, Baman Baroda, District Sawai Madhopur. In that capacity, it is alleged that he made an embezzlement of Rs. 9720/- which belong to the State. A case was registered. 2. During arguments, it was stated by Mr. Goyal that the amount of Rs. 9720/- has been deposited by the petitioner in the State Govt. through the District Education Officer, Karoli. Nothing is to be recovered from him now. In case he is arrested, he will be put under suspension and that will cause a big loss to him. 3. Learned Public Prosecutor has frankly conceded that the petitioner has deposited the embezzled amount of Rs. 9720/- and nothing is to be recovered from him now. 4. Having regard to the facts and circumstances of the case and specially the fact that the amount of embezzlement running in to Rs. 9720/- has already been deposited by the petitioner in the State Govt, it would not be improper to allow this application for anticipatory bail. 5. The application is allowed. The Investigation Officer, Police Station Gangapur City is hereby directed that in the event of arrest of accused Govind Sharan Sharma in Police Case No. 290/88 pending investigation at Police Station, Gangapur City for offence u/ss. 406, 409 and 420 I.P.C. he shall be immediately released on bail. The accused is directed not to intimidate or whenever the prosecution witnesses and to make himself available for interrogation before the Investigating Officer as and when directed by him.Application allowed. *******
