JUDGMENT 1. 1. This revision is against an order rejecting the petitioners' application calling for cross-examination under Order 19, Rule 2, C.P.C. a person who has filed an affidavit in support of an application made by the plaintiff for grant of a temporary injunction under Order 39, Rules 1 & 2. C.P.C. The trial court has rejected this prayer on the only ground that Order 19, C.P.C. does not apply to a matter relating to grant of a temporary injunction under Order 39, C.P.C. placing reliance on a Single Bench decision in Kusum Kumar Choudhary v. Supra Films (1971 RLW 282) . Learned counsel for the petitioners stated that there is no other direct decision of this court on this point relating to applicability of Order 19, C.P.C. in a matter pertaining to grant of a temporary injunction under Order 39, C.P.C. 2. Learned counsel for the petitioners placed reliance on a Single Bench decision of Andhra Pradesh High Court in Ali Bin Aifan (1983 AP 114) holding that Order 19, C.P.C. is applicable for deciding the application under Order 39, C.P.C. He also referred to some other decisions in support of this view. A Division Bench in Kanihyalal v. Meghraj (AIR 1954 Nag. 260) has held that the expression any application' under Order 19, Rule 2, C.P.C. means 'any application' under the Code since the Code itself does not define the word 'application' nor does it make any distinction between one application and another. In view of these authorities which are not considered by the learned Single Judge in Kusum Kumar Choudhary's case (supra) it would be proper to reconsider the correctness of the view taken therein. The matter has, therefore, to be referred for decision by a larger Bench. 3. The point for decision is as under:- "Whether the provisions of Order 19, C.P.C. apply for deciding an application for grant of temporary injunction under Order 39, C.P.C.? 4. The papers be laid before the Chief Justice for constituting a larger Bench to decide the above point. Since this is the only point for decision in the revision, the revision itself be laid for decision by the larger Bench.Revision referred for decision by larger bench. *******
