Order Heard learned counsel for the petitioner as well as the State. 2. this is an application for grant of anticipatory bail to the petitioner in a case under section 395 I.P.C. 3. In a case under section 395 I.P.C. where the accused is not named, the first principle of investigation is to put the accused on test identification parade for identification, and if the accused is not identified at the T. 1. parade, he becomes entitled for bail. It is for this reason that the prayer of the petitioner for anticipatory bail in the present case cannot be considered. He is directed to surrender in the Court below at an early date and the Court below will get T. 1. Parade of the petitioner held at the earliest. If an application for regular bail is filed on behalf of the petitioner in the Court below, it will abide by the result of the test identification parade. 4. With the above observation this petition for anticipatory bail of the petitioner is disposed of. Application disposed of.
