ORDER : 1. We have heard learned counsel for the parties and we have also seen the child produced before us. The whole question before us whether in the facts and circumstances of the case the custody of the child should be directed to be handed over to the mother, the petitioner. It appears of the look of the child that the child is very tenerous aged about 2 years old or more. Considering the welfare of the child we deem it just and proper that the child should be handed over to the custody of her mother that is the petitioner. We also make it clear that we are making this order with the sole consideration of welfare of the child. We do not make any observation whatsoever of the merits of the question regarding the validity of the deed of adoption that has been produced before us. All other matters are kept open and the parties are at liberty to seek relief in an appropriate forum. The child has been handed over to the mother that is the petitioner in presence of the Court. The writ petition is disposed of.
