JUDGMENT 1. 1. The only relief to which the petition is confined during the course of argument is that she applied for re-valuation of paper III-A History of Rajasthan (1176- 1900 AD) of M.A. Final History of the examination of University of Ajmer within time and also sent the requisite fee but the re-valuation was not done on the ground that the fee which was remitted was Rs. 75/-. The petitioner has a right for re-valuation of his (sic her) answer-books in the aforesaid subject. 2. Before the Ajmer University was formed Amjer (sic) came under the University of Rajasthan and under Ordinance 157-A of the University of Rajasthan and more so its Clause (6) the fee for re-valuation of answer book was Rs. 50/- per paper which was not refundable except when the candidate is allowed to with draw his application as provided under Clause (5) of the aforesaid Ordinance. Under the circumstances and even otherwise even if there would have been any provision for payment of Rs. 75/- as re-valuation fee, the authorities could not have declined to do the re-valuation of the answer book sought by a candidate on the ground that the fee remitted was deficient. In the instant case it appears that the only ground on which the re-valuation of the answer book was declined by the Registrar, University of Ajmer is that the petitioner had deposited only Rs. 50/- when the re-valuation fee is Rs. 75/- per paper. Even in the letter of the Registrar dated February 7, 1989, the relevant Ordinance in which the candidate was required to deposit Rs. 75/- as re-valuation fee has not been quoted or even mentioned. 3. Consequently, the writ petition is allowed and it is directed that if the petitioner deposits Rs. 75/- as fee for re-valuation within seven days with the University of Ajmer, the Registrar, University of Ajmer, is directed to give a receipt of the deposit of fee and is further directed not to refuse the deposit of the amount and the answer book of the petitioner of paper III-A History of Rajasthan (1176- 1900 AD) shall be re-valuated and result shall be intimated to the petitioner. The entire exercise may be completed within a period of one month from the date of receipt of the fee.Petition allowed. *******
