JUDGMENT 1. - This is a fourth application for bail on behalf of the petitioner Naib Singh, who is facing trial for offence under section 307 IPC.The first application was rejected by this Court on 15-7-87. As the challan had only been filed by that time, the application was rejected at that stage. The Second application was then again rejected on 27-7-88 and the trial Court was directed to expedite the trial and complete it as early as possible. Then a third application was moved and the same was rejected on 18-1-89 with a direction that the prosecution shall now complete its evidence within two month; from today. It will be the duty of the Public Prosecutor to see that all the prosecution witnesses whom he wants to examine are served and produced before the court and no adjournment is sought on the ground that the witnesses are nut present or not served. After completion of the prosecution evidence, the learned Addl. Sessions Judge No. 2, Hanumangarh, will try to complete the trial within one month thereafter. While giving this direction it was also observed that it clearly appeared that the prosecution was delaying the trial. Despite this dear direction, it appears that the trial has not been completed and, therefore, this fourth application for bail has been filed. The learned counsel for the petitioner has placed the order-sheets of the trial Court for my perusal and from their perusal, it appears that the Investigation Officer not been appearing for the last seven hearings since April, 1989 and the prosecution's evidence is, therefore, I not yet over. The only conclusion, therefore, is that the prosecution is not caring for the directions of this Court and has not been taking steps to produce its witnesses and in these circumstances. I am of the opinion that the petitioner should not be allowed to suffer any more on account of the lathes of the prosecution. 2. I, therefore, direct that the petitioner Naib Singh shall be released on bail on his furnishing a personal bond in the sum of Rs. 5,000/- with one surety in the like amount to the satisfaction of the learned Addl. Sessions Judge, Hanumangarh Camp Suratgarh, for his appearance before that court on the next date of hearing and on all subsequent dates.Bail granted. *******
