ORDER : 1. We have received a telegram from the Delhi Judicial Service Association, Tis Hazari Court, Delhi, drawing the attention of the Court to certain incidents which have taken place at Nadiad, State of Gujarat, in which a Chief Judicial Magistrate is alleged to have been arrested by the Police and dragged by the Police after hand cuffing and tying his hands and legs and that as a consequence of the said incident all the judges of the subordinate judiciary in Gujarat have gone on strike and the Courts have ceased to function. Since this is a matter which requires immediate attention of this Court in order to safeguard the independence of judiciary, we entertain this case as a public interest litigation and issue emergent notices to the State of Gujarat, to the Director General of Police, Gujarat, to the Registrar of the High Court of Gujarat and to the Delhi Judicial Service Association. 2. Since we have taken cognizance of this matter, we hope the members of the judiciary in the State of Gujarat and the lawyers will resume the work to avoid inconvenience to the general public. 3. List this matter on 3rd October, 1989 as the first case before this Bench. 4. We direct the State of Gujarat and other respondents to file their statements explaining the circumstances which led to the incident and the action taken by them on 3rd October, 1989. 5. This notice shall be communicated to all the Respondents by telex forthwith. The Delhi Judicial Service Association may also be served with notice by the Registry by tomorrow.
