ORDER : 1. W.P. Nos. 161/87, 1285/87, 34, 44, 134, 152, 211 & 218/88, T.P. Nos. 289-90 of 1988 W.P. No. 214 & 579,189. 1. By consent of the parties the Writ Petitions 1073 of 1989 and 1074 of 1989 are treated as on board today. I. A. No. 1/89 (In WP. No. 161/87) & 1. A. No. 3/89 (In WP. No. 1285/87). 2. Both these applications for amendment are allowed only the extent of substituting prayer (bb) in place of the original prayers in the respective Writ Petitions. 3. The parties to the Writ Petitions including the Union of India and the National Textile Corporation and its subsidies have agreed that the disputes between the parties should be referred to the National Industrial Tribunal to be constituted by the Union of India under Section 7B of the Industrial Disputes Act, 1947. In view of the said agreement, we direct that all the disputes raised in the Writ Petitions be referred to the National Industrial Tribunal. The respondents will be at liberty to raise their contentions before the Tribunal in regard to all the disputes raised in the Writ Petitions. The Tribunal shall allow the parties to adduce evidence both oral and documentary and after considering the evidence and hearing the parties, shall give its findings in respect of all these disputes and the contentions that may be raised by the respondents. The Union of India shall constitute the Tribunal within a month from today. The Tribunal shall conclude the proceedings as expeditiously as possible, preferably within a period of nine months after its constitution. A copy of the findings of the Tribunal shall be remitted by it to this Court within a period of one month from the date of its findings.
