JUDGMENT 1. 1. This is a second bail application by the petitioner. He was not named in the first information report as a person who had fired at the deceased Lasu but in the subsequent statements, witnesses had assigned this role to this petitioner. Two other persons namely Hori Lal and Siya Ram or Hori Lal and Ram Chandra are said to have fired at Lasu. Two witnesses have been examined by the Sessions Judge and they have not supported the prosecution case. So far this petitioner is concerned, the witnesses have stated that they knew Kanwar Pal, petitioner prior to the occurrence and he was not present at the time of occurrence. Other witnesses remain to be examined. Hence, without expressing any opinion on the merits of the case, it can be said that the petitioner can be released on bail. 2. It is, therefore, ordered that the accused petitioner Kanwar Pal be released on bail on his furnishing a personal bond in the sum of Rs. 5,000/- (Rupees Five Thousand) with one surety in the like amount to the satisfaction of the trial court for his appearance before that court on all dates of hearing during the pendency of the trial in this case.Bail Granted. *******
