JUDGMENT 1. 1. I have gone through the injury report and it appears that the injury on the head was simple injury by sharp edged weapon. In the case of present nature. I fail to understand as to how the officer of level of the learned Sessions Judge can and should refuse the bail. Such like orders only increase the burden of this court unnecessarily. The officers of the learned Sessions Judge level are expected to discharge their duties assigned to them under law and the officers concerned should not be afraid of this court while exercising their jurisdiction under section 439 Cr. P. C. and should deal with a case under the facts and circumstances of a particular case without fear. 2. I direct the learned Sessions Judge to take note of these observations in future. Not only he but other Sessions Judges should also take note of these observations. 3. I hereby allow the bail application and direct that the petitioner shall he released on his furnishing a personal bond in the sum of Rs. 6000/- with one surety in the like amount to the satisfaction of the trial court with an undertaking to appear before him or any other court as and when he is called upon to do so.Bail granted. *******
