JUDGMENT S.K. Dhaon, J. - It is admitted that on 25th September, 1989 a sum of Rs. 82,583.75 paisa recovery charges was payable by the petitioner to the Allahabad Bank, Mariham, District Mirzapur. The only prayer made is that some instalments may be fixed to enable the petitioner to pay off the amount. 2. We are informed that auction of the property of the petitioner has already taken place and there is an imminent danger of the same being confirmed. The confirmation of sale of the property of the petitioner shall remain stayed provided he fulfils the following conditions : 1. A sum of Rs. 20,000/- shall be paid by the petitioner to the Bank aforesaid within a period of one month from today. 2. The balance shall be paid off by the petitioner in three equal quarterly instalments. The first instalment shall become payable immediately after the expiry of a period of three months from the date of deposit of the amount under our order. 3. The petitioner shall be liable to pay up-to-date-. interest calculated by the Bank which shall be paid along with the last instalment. 4. The petitioner shall be liable to pay only 50% of the recovery charges. 5. Attachment, if any, of the property of the petitioner shall continue till the last instalment is paid off by her. 3. In the event of default of any of the conditions, this order will become ineffective and it will be open to the Bank to realise the entire amount by taking recourse to any provision of law which may be available to it. 4. With these directions, the petition is disposed of finally. 5. A copy of this order may be given to the learned counsel for the petitioner on payment of usual charges within 48 hours.
