JUDGMENT : C.M.P. NO. 25269/1988 1. It is directed that those who are physically handicapped should be recruited in accordance with the procedure laid down by the notification of the Government which are Annexures 'J' and 'K' of this Civil Misc. Petition. The Selection Committee before making selection may verify the certificate given in favour of the individual persons certifying that they are entitled to be recruited in accordance with these notifications. For such verification, if and when, occasion arises and if the Selection Committee so considers in appropriate cases may call up the persons for personal verification or interview. For the posts for which the physically handicapped persons are eligible and they apply, should be recruited in future, in accordance with this procedure. If any individual is aggrieved that the procedure is not correctly followed he will be at liberty to make representation to the appropriate authority viz. the Chief Personnel Officer of the respective Railways. In case his/her grievance is still not met then the individual person would be at liberty to take appropriate legal proceedings in accordance with law. In making such selection if there are any other allied notifications apart from Annexures 'J' and 'K' which according to the person concerned have not been adhered to in making the selection they will be at liberty to draw the attention of the appropriate authorities to those notifications and the authorities will take into consideration those allied notifications issued by the Government. With these directions the Civil Miscellaneous Petition is disposed of. No further directions are necessary. C.M.P. NO. 10879/1988 2. So far as Sri Sarat Chandra Nayak mentioned at page 41 of the paper-book is concerned, who is the applicant in the C.M.P., he will be admitted in accordance with the procedure indicated in Annexure 'G' being letter of the Directorate General of Health Services, New Delhi, dated 4th December, 1984. Accordingly, he should be given admission if he, fulfils other conditions and requirements for training in the Para-Medical Workers Training Course. This order will be effective provided there is no other direction or letter issued by the Directorate General of Health Services, New Delhi, in modification or alteration of the aforesaid letter dated 4th December, 1984 until and unless such direction made at page 46 of the paper-book is modified, revoked or cancelled.
