JUDGMENT V. Kumar, J. - This writ petition is directed against the order of suspension dated 17289, contained in Annexure No. 1. The petitioner further prays that he may be allowed to continue in service and paid his salary. 2. Both the sides have been heard and they are agreed that this petition may be disposed of finally. 3. In connection with the contemplated departmental inquiry suspension order was passed on 1721989. 4. Firstly, learned counsel for the petitioner contended that there is no provision warranting for suspension, pending enquiry. Secondly, it is also argued that the departmental enquiry has gone for such a long time that the suspension order is operating for the last one year and ten months despite the cooperation of the petitioner in the departmental proceedings. 5. Suspension order is set aside. The departmental proceedings shall proceed provided that petitioner cooperates. 6. With these observations the writ petition is disposed of finally.
