State of Goa v. Jorgo Anibal De Matos Sequeira

1990-03-06

K.J.SHETTY, R.M.SAHAI

body1990
ORDER : Special leave granted. Having heard counsel on both sides and also perused the material and in particular the report Of The Land Acquisition Officer Under Section 5-A, We Are Of The Opinion that there is no proper consideration of the contentions raised in the Writ Petition before the High Court. It is appropriate that the High Court considers all the questions raised by the owner of 4 the property instead of resting the conclusion only on the cost of conversion and renovation of the property. 2. We, therefore, set aside the order of the High Court including the finding relating to the cost of conversion AND DIRECT HIGH COURT TO CONSIDER THE OTHER GROUNDS RAISED BY THE OWNER. THE High Court may dispose of the Petition as early as possible within a period of 6 months. Appeal is disposed of accordingly. In the circumstances, we make no order as to costs.
