JUDGMENT 1. - I heard learned counsel for the petitioner yesterday. Mr. Chaudhary on behalf of the State is present today. 2. On 26th Sept. 1989 this Court had directed that some investigation should be made into the background of the accused petitioner. Time was taken on a number of occasions and on 9.2.1990 it was directed that a letter be written to the SHO, Raniya Road, Sirsa (Haryana) to send some particulars about the accused petitioner including his occupation, members in his family, permanent abode property etc. To this communication a report has been received from the SHO, Raniya Road, Sirsa (Haryana). In this report it has been mentioned that he lives' in a rented house for the last four five years, he has purchased a plot on Barnala Road, Sirsa for Rs. 5,000/-, registry of which is in his name and that no case is pending against him. The particulars about the place where he used to earlier reside are also given. His conduct is said to be good. 3. The facts of the present case are that near Nasirabad a Maruti car was detained in which about 80 kgs. opium was found concealed in the doors and the speakers etc. One Kashmiri Lal was driving the car and two persons were sitting on the rear seats of whom one is the petitioner. His case is that he has taken a lift in this vehicle. 4. I do not want to comment on the facts of the case. Some information about the background of the petitioner has been received and on the basis of this it can be said that he can be released on bail on appropriate conditions. 5. The petitioner shall be released on bail on bis furnishing a bail bond in the amount of Rs. 20,000/- with two sureties in the amount of Rs. 10,000/- each to the satisfaction of the Sessions Judge, Ajmer for his appearance during the course of trial on all dates of hearing and as and when he is called upon to do so. 20,000/- with two sureties in the amount of Rs. 10,000/- each to the satisfaction of the Sessions Judge, Ajmer for his appearance during the course of trial on all dates of hearing and as and when he is called upon to do so. At-least one surety shall be person residing within the jurisdiction of the court and having immovable property besides agricultural land, further conditions are also imposed as under:- (1) the petitioner shall not change his place of residence from where he is residing at present; (2) he shall not dispose the plot of land which he owns on Barnala Road, Sirsa. Patta of this land shall be deposited with court; (3) he shall present himself once a month before the Police Station Raniya Road, Sirsa (Haryana) and will inform the Police Station about his movement out of Sirsa. 6. On furnishing bail bonds as stated above the petitioner shall be released on bail, if he is not wanted in any other case and there is no other order seeking his detention.Bail granted. *******
