JUDGMENT 1. Heard learned counsel for the parties. 2. Shri Basir Khan, deceased, was the Government employee and was holding the post of Constable at the time of his death. The case of the present petitioner is that at the time of sad demise of Basir Khan he was minor and on attaining the majority he applied for appointment under the Rules in the year 1983, being the son and dependent of Basir Khan. He has produced the copy of the first application (Annex. P.3), before this Court. Thereafter, every time the petitioner moved one authority after the another authority and forwarded his applications for due consideration. Mr. Rathore submits that the Dy. Secretary to the Government of Rajasthan directed the Director General of Police on 18.5.87 to give appointment to the petitioner according to the rules. Petitioner, thereafter, moved the authorities and submitted before them the requisite information desired by them including his qualification and information relating to the typing knowledge. However, the matter is still pending with the authorities concerned. 3. There are two pet words of the Government namely, "matter is under consideration" and "matter is under due process". How much time the State Government or the authorities take to process a matter or to consider the matter is not known to anyone and every citizen has been deprived of his valuable right by keeping the matter pending under consideration for unlimited time. It will not be out of place here to mention that the process may continue for decades. A poor man has approached the authorities and requested that he should be given appointment, but the petitioner has not been given appointment inspite of the directions given by the Government in the year 1987. State Government was not vigilant in conducting the case, as per usual practice, every time the adjournment has been sought for and this Court has granted adjournments. On 21.2.90 Mr. K.S. Rathore prayed for adjournment, on 14-3-90 Mr. Pareek prayed for adjournment and on 9.4.90 Mr. Chaterjee prayed for adjournment. Today again Mr. Rathore submitted that the reply has not been filed and prays for adjournment. This shows that the officers of the State are not vigilant in assisting the Government Advocates who are appearing on behalf of the State. 4. The State Exchequer may lose but the system will not improve.

Generally, we see that the Law Officers are coming to the Courts without files and and in the usual way a submission is made in the sublime manner that " QkbZy ugha vkbZ gS ". If this happens and the State Government fails in assisting the Government Advocate then none can be blamed Mr. Rathore submits that the staff is demanding extra time allowance and the matter is pending with the Government. May it be so. Public money is not to be wasted and it should not be granted as a charity. If the Peshi Register is maintained there will be no problem and there will be no necessity of extra work. It is the failure of the administration and Policy of the Administration, which is creating the problem for the last number of years. We fail to understand that why the Peshi Register is not maintained by the G.A. Office and why the files cannot be delivered before two days prior to the date filed to the Government Advocate. It may be a case of weakness of the Administration and none can please everyone. The rule of sycophancy is always harmful and some persons must come forward to bear the burns. Copy of this order may be sent to Chief Secretary. 5. In the result, we accept the writ petition and direct the Director General of Police to give appointment to the petitioner on a suitable post for which he is eligible within a period of one month from today as per rules. State Government shall pay Rs. 500/- as costs to the petitioner.Petition accepted with costs. *******
