JUDGMENT 1. - It is submitted by Mr. Anil Jain, learned counsel, that allegation against the petitioner is that he is responsible for theft of telephone wire. In FIR, no name has been mentioned. It is pointed that the trial Court has rejected bail application of the petitioner in all these cases, merely on the ground that since other cases are also pending against the petitioner, therefore, he does not deserve to be released on bail. The learned counsel has placed reliance on Vijay Singh v. State of Rajasthan, 1988 (1) RLR 155 . in which, it was held that the application for bail cannot be refused, merely on the ground that some other cases are also pending against the accused. 2. The accused is in jail since 21/2 months and offence is triable by the learned Magistrate. 3. In the facts & circumstances, I am inclined to grant bail to accused-petitioner Bhoori Singh under Section 439, Cr. PC. It is, therefore, ordered that accused-petitioner Bhoori Singh be released on bail, provided he furnishes a personal bond in the sum of Rs. 10 000/- (Rupees ten thousand only) with two sureties in the sum of Rs. 5,000/- (Rupees five thousand only) each to the satisfaction of the learned Sessions Judge, Dholpur, with the stipulation to appear in that Court as and when called upon to do during the pendency of the trial against the accused-petitioner in this case.Bail Granted. *******
