JUDGMENT 1. - Heard learned Prosecutor for the State. 2. Counsel for the petitioner submits that the accused of in jail since Sept. 5, 1986. There eye-witnesses were examined on Oct. 25, 1989, and thereafter nine different dates were fixed in the trial but not a single witness has been examined. The three eye-witnesses examined have not supported the prosecution case. 3. Having regard to the facts and circumstances of the case, particularly the delay in the trial, the accused deserves to be enlarged on bail. 4. Accordingly it is directed that the accused petitioner Om Dass s/o Tulsi Das shall be released on bail provided he furnishes a personal bond in the amount of Rs. 20,000/- (Rupees twenty thousand only) with two sureties of Rs. 10,000/- (Rupees ten thousand only) to the satisfaction of the Sessions Judge, Pali to appear in the trial Court on each and every date of hearing or whenever called upon to do so till the disposal of the trial.Bail Granted. *******
