JUDGMENT 1. - In this application under Section 482 Cr.P.C., the accused petitioners prayed that the order dated 2-5-1988, passed by A.C.J.M. No. 5, Jaipur City, taking cognizance against the petitioners u/s 323, I.P.C. be quashed. 2. Counsel for the petitioners submits that on 14-4-1988, the non-petitioner No. 2, Shri Nand Kishore filed a complaint under Sections 323, 341, 451, 540 read with Section 34 I.P.C. against the three accused persons including the petitioners. The trial court recorded the statement of complainant and two witnesses viz. Ram Avtar and Shiv Kishore. Thereafter, the trial court took cognizance only against the petitioners under Section 323 I.P.C. 3. I have gone through the complaint and the statements of the witnesses produced by the petitioners. After going through the record of the case, I am of the view that no case u/sec. 323 I.P.C. is made out against the petitioners. 4. In view of this and in the interest of justice, I quash the order dated 2-5-1988, taking cognizance against the petitioners. 5. Copy of the order may be sent to the trial court.Petition allowed. *******
