JUDGMENT 1. - Heard learned counsel. It is clear from Ex. 76 that the petitioner was suspended by order dated Oct. 19/23, 89, on the ground that disciplinary proceedings were contemplated against him. It was admitted by learned counsel for respondent No. 1 that although a period of 10 months has elapsed, but, so far, no Charge-Sheet has been served upon the petitioner. Where an employee is suspended on the ground that disciplinary proceedings are contemplated against him, charge-sheet should be served on the petitioner within a reasonable time, after his suspension. An employee cannot be continued under suspension for 10 month long period without any charge-sheet being served upon him. In such circumstances, the continued suspension of the petitioner became totally unjustified. 2. I allow this stay application and direct respondent No. 1 to revoke its suspension order (Ex. 76) within a week.Stay application allowed. *******
